Update your will with Morrish Solicitors

It is important that your will is updated after a significant life event. These events may have an impact both on your wishes for the distribution of your estate and on the validity of your current will.

Below are some examples:

Buying or Selling a Property

Property is usually the main asset of a person’s estate. Updating your will can ensure that your property passes to your choice of beneficiary when you die. If the property is in joint names and held as joint tenants, it will go to the surviving partner whether they are married or not. If the property is held as tenants in common, each partner can appoint their share of the property to their choice of beneficiary in their will.

Marriage or Civil Partnership

Wills made prior to marriage or civil partnership are not valid unless it included specific wording at the time it was prepared. If your will is not updated, the law will decide who inherits your estate when you die.

Children/Grandchildren

You may wish to include any current children/grandchildren as well as future ones who may be alive at the time of your death. You may also wish to appoint Guardians for any minor children until they reach the age of maturity.

Divorce or Civil Partnership Dissolution

Wills remain valid following a divorce or civil partnership dissolution. However, many provisions would no longer be effective if you pass away before making a new will.

Financial Circumstances

If the value of your assets goes up or down, your will should reflect this. Your will should be updated not only to reflect your wishes but also to minimise your tax liability. Inheritance Tax is payable on estates valued over £325,000 and the tax rate is 40%.

Death

If someone named in your will has died, you should remove their name. Failure to do this can bring problems when it is time to administer your estate.

Name change

If you change your name or anyone mentioned in your will change theirs, this should be updated in your will.

  1. Both my husband and I are members of Napo and we both need Wills. For that matter, possibly some sort of power of attorney for each other, as we are both over 65.
